The Status of Women in Islam: An Evaluation of Testimony and Debt in the Qur'an

Islam addresses its approach to women from many different perspectives, and the Qur'an includes various regulations emphasizing the value of women, their protection, and the safeguarding of their rights. Although some atheist viewpoints misinterpret certain verses of the Qur'an and claim that Islam devalues women, the essence of the Qur'an is built upon protecting women's rights and treating them with compassion and mercy.
In the Qur'an, regulations concerning debt and testimony aim to ensure social order and establish justice between parties. Verse 282 of Surah Al-Baqarah contains important rulings regarding the documentation of debts and the provision of witnesses. The verse states:
> “O you who believe, when you contract a debt for a specified term, write it down. Let a scribe write it down between you in justice… And bring to witness two witnesses from among your men. And if there are not two men, then one man and two women from those whom you accept as witnesses—so that if one of them errs, the other can remind her…” (Al-Baqarah, 282)
This verse requires witnesses in financial transactions, specifying one man and two women in certain cases. However, the purpose of this regulation is not to diminish the value of women, but rather to protect their psychological and physical well-being. Testifying can be a difficult responsibility and may expose individuals to pressure or threats. To ease this burden, women are assigned this responsibility collectively. This arrangement aims to reduce the strain on women and provide them with greater comfort.
Testimony plays a crucial role in society. However, bearing witness can sometimes put individuals at risk, especially in disputes involving financial matters. In the same verse, it is stated:
> “And the witnesses should not refuse when they are called upon…” (Al-Baqarah, 282)
This serves as a warning to those who avoid fulfilling their duty as witnesses. Testifying can create tension between parties, and witnesses may be subject to intimidation. This risk may be greater for women in certain contexts. Therefore, the Qur'an seeks to minimize such pressures on women by assigning greater responsibility in this regard to men. If male witnesses are not available, then one man and two women are accepted. This aims to reduce pressure on women and ensure their protection.
The Qur'an considers men and women equal in terms of their deeds. In Surah An-Nur (24:6–8), regarding accusations of adultery, both parties are required to take oaths:
> “And the punishment will be averted from her if she bears witness four times by Allah that he is indeed of the liars.” (An-Nur, 8)
Here, equality between man and woman is clearly established. A woman may testify four times to counter her husband’s claim, and her testimony is considered equal in weight. This demonstrates that women possess equal rights and that their oaths are equally valid.
In some verses, men are assigned greater responsibilities. However, this does not imply that women are inferior. On the contrary, such arrangements are intended to ensure the protection and well-being of women. The responsibility placed upon men in Surah Al-Baqarah (2:282) stems from their broader engagement in public and economic life. Women, on the other hand, are considered in a more protected and delicate position within family and social structures, and these regulations aim to ensure their safety and comfort.
The Qur'an recognizes both men and women as equal in essence. However, considering natural differences and social roles, certain provisions offer additional protection to women. In matters such as testimony, the Qur'an reduces the burden on women to shield them from potential pressure and risk. These regulations are designed to safeguard women and promote their well-being.
Claims that such rulings devalue women stem from misunderstandings or misinterpretations. On the contrary, Islam values women, protects them, and seeks their welfare.
